Terms and conditions for visitors to airborne museum hartenstein oosterbeek and airborne at the bridge arnhem

These Terms and Conditions are applicable to all Visitors to the Airborne Museum in Oosterbeek and Airborne at the Bridge at Arnhem as well as to all natural persons and/or legal entities engaged by Stichting Airborne Museum in pursuance of its object. These Terms and Conditions are also applicable to special events outside of the regular opening hours and/or aimed at others than the regular Visitor, in case of exclusive events. By purchasing an Admission Ticket you accept these Terms and Conditions. You can also consult the Terms and Conditions for Visitors at our ticket office and information desk.

Definitions

1.1 In these Terms and Conditions for Visitors the following is understood by the terms:

  • Visitor: anyone who enters the Museum for the purpose of visiting the exhibition or research in the archives, or to visit a reception, conference, lecture or similar meeting;
  • Admission Ticket: a ticket (whether or not combined with a discount card) or similar document (e.g. a written invitation, voucher, annual Museum Card, etc.) that grants the holder access to the Museum;
  • Museum Officials: all natural persons who work in and around the Museum by order of the Museum;
  • Museum Complex: the total of area (build and unbuild) that is open to the public and part of, or belonging to, the buildings known locally as “Airborne Museum” and “Airborne at the Bridge”;
  • Museum: the legal entity Stichting Airborne Museum;
  • Exhibition spaces: all areas in the Museum Complex and belonging to the Museum that have been appointed as being exhibition spaces by the Museum.

Access

2.2       The Visitor is only allowed to enter the Museum Complex with a valid Admission Ticket.

2.3       A Visitor can be denied entry to the Museum Complex when:

  1. the Admission Ticket, discount card, or voucher of the Visitor has not been purchased from the Museum or another institution that has been approved by the Museum;
  2. the Visitor disturbs the peace or has the intention to do so;
  3. the Visitor does not wish to identify themselves before entering the Museum;
  4. the Visitor is not prepared to cooperate in the checking of baggage such as bags, small backpacks or prams;
  5. other Visitors are disturbed by excessive noise, which includes but is not limited to, the use of mobile phones and wireless audio equipment;
  6. the Visitor does not overall behave as a reasonable Visitor might be expected to behave.

2.4       An Admission Ticket is no longer valid once the date or timeslot that is printed on the ticket has passed. An expired or unused Admission Ticket cannot be exchanged for a new and valid Admission Ticket, nor is there the possibility of a refund. The Visitor is obliged to show the Admission Ticket as well as possibly connected cards such as a Museum Card or a voucher that gives a discount on the entrance fee, possibly in combination with a valid ID, when asked to do so by a Museum Official.

2.5       The Museum is not obliged to reimburse the costs of an unused Admission Ticket. Restitution is not possible for complaints of a Visitor in regards to:

  1. the not being on show of objects in the permanent collection of the Museum;
  2. the partly being closed of the Museum Complex, which includes but is not limited to a partial closing as a result of the construction or deconstruction of exhibitions;
  3. a change in the regular opening hours due to a training in emergency response (BHV) or a calamity;
  4. disturbances or inconveniences caused by other Visitors, e.g. excessive noise, inappropriate behaviour, theft and injury;
  5. disturbances or inconveniences caused by maintenance of, or the rebuilding or renovation of, the Museum Complex;
  6. disturbances or inconvenience caused by the nonoptimal function of the Museum Complex’s facilities;
  7. disturbances or inconveniences caused by (large) crowds.

2.6       Visitors under twelve years of age can only visit the Museum Complex when accompanied by an adult Visitor. They will make sure that, amongst others, the accompanied Visitor will not touch the objects on display.

Internal rules and regulations

3.1       Within the Museum Complex the Visitor is prohibited from, amongst other things:

  1. touching exhibits, unless explicitly indicated otherwise;
  2. offering goods of any kind for sale to third parties or supplying them free of charge without the express written consent of the Management;
  3. inconveniencing other visitors, including, but not limited to, blocking their view of exhibits for long periods or causing excessive noise;
  4. bringing dogs into the Museum Complex, with the exception of assistance dogs;
  5. using private means of transport, with the exception of wheelchairs, pushchairs, buggies, walking frames, and other generally accepted aids.
  6. photographing, filming or making audio recordings in the Museum Complex, unless solely for private use. It is not allowed to use video or audio recording for commercial goals without the express written consent of the Management;
  7. smoking, which includes e-cigarettes;
  8. eating or drinking in the Museum Complex, with the exception of purchased food and drinks in the café area.

3.2       Parents, teachers and other supervisors are responsible and accountable at all times for the behaviour of the minors, individuals or groups who they have brought to the museum or are under their supervision. For visits by primary or secondary schools, there must be at least one supervisor for every 8 pupils. The Museum reserves the right to refuse access to groups who do not meet this requirement.

Liability of the Museum

4.1       The Visitor accesses the Museum Complex at his/her own expense and risk.

4.2       The Museum is liable only for damage that the Visitor suffers as a direct consequence of gross negligence or intent on the part of the Museum or its officials, with the proviso that only damage for which the Museum is insured, or should have been insured in accordance with the requirements of reasonableness and fairness, qualifies for compensation. Any liability on the part of the Museum is excluded if it regards indirect damages, such as consequential damage or diminished profits or salaries.

4.3       Any liability on the part of the Museum is excluded if, amongst other things:

  1. damage is caused in any way by other visitors;
  2. damage results from failure to follow instructions given by the Museum’s officials and from failure to observe prevailing standards of decency;
  3. damage results from actions of third parties, including persons engaged by the Museum and parties who hire (rooms within) the building and persons engaged by these third parties;
  4. goods are accepted or goods are deposited, stored en/or left by anyone at any location.

4.4      Any claim will in any case be limited to the amount paid out by the insurer or a third party in connection with the individual claim concerned.

Liability of Visitors

5.1       The Visitor to the Museum Complex is liable for any direct or indirect damage that he/she causes, whether or not as a result of failure to comply with these Terms and Conditions for Visitors, and indemnifies the Museum against any associated third-party claims.

5.2       Organisations that organise meetings, events and/or parties within the Museum Complex (or arrange for such to be organised) are responsible and liable at all times for the behaviour of the guests they invite, without prejudice to the personal responsibility and liability of these guests.

5.3       The Museum will on no account be liable for any damage suffered by the Visitor as a result of circumstances beyond the Museum’s control (force majeure). Force majeure is understood to include any foreseeable or unforeseeable circumstance beyond the Museum’s control that temporarily or permanently prevents or impedes the performance of the agreement of entrance to the Museum. Force majeure is also understood to include the following: natural disasters, strikes, terrorist attacks, electrical errors and industrial action.

Complaints procedure

6.       A Visitor can send complaints and suggestions for the improvement of the Museum by email to info@airbornemuseum.nl. Any complaints connected with the visitor agreement must be lodged with the Museum in writing within six weeks of the date of visiting. Complaints lodged after this period will not be processed. The museum will investigate the complaint and will endeavour to process it within ten working days of receipt. If the investigation has not been completed within this period, this will be notified to the complainant and an indication will be given of the expected completion date.

General Data Protection Regulation

7.1       The processing of personal data by the Museum conforms to the General Data Protection Regulation (GDPR) as a Visitor uses our services and/or gives us access by filling out a form on the website of the Museum. While processing personal data, the privacy of the Visitor is respected and only the absolutely necessary personal data are processed.

7.2       There is video surveillance in and around the Museum Complex. Video footage is saved according to the GDPR and will, when necessary, be made available to the police.

Other provisions

8.       If one or more of the above articles are or become legally invalid, this will not affect the legal validity of the other provisions. In such a case the invalid provision will be replaced with a new provision that corresponds as closely as possible with the old invalid provision in terms of its content, scope and/or purpose.

Applicable law and choice of forum

9.      The applicability of these General Terms and Conditions for Visitors does not affect the applicability of any other contractual conditions and/or regulations of the Museum, including, but not limited to, the Additional Terms and Conditions for Bookings and the Uniform Terms and Conditions for the Hotel and Catering Industry.  These General Terms and Conditions for Visitors and the agreement between the Visitor and the Museum are governed by Dutch law. All disputes connected with the Admission Agreement and the Terms and Conditions for Visitors will be settled by the judge that has the competence at the Court of Gelderland, located in Arnhem.
